1. Scope of Application, Definitions
1.1. These General Terms and Conditions (GTC) apply to all contracts entered into between the provider
Pacoma Creative Labs – Owner: Christian Renschler, c/o Impressumservice Dein-Impressum, Stettiner Str. 41, 35410 Hungen, Germany, Tel.: 01579-2341658, info@mythiccards.ai (the “Provider”), and users of the “Mythic Cards” platform (the “User(s)”) via the website mythiccards.ai.
1.2. Any differing terms and conditions of Users shall not apply unless expressly agreed by the Provider
in writing.
1.3. A “User” of Mythic Cards may be any natural person who has reached the age of 18, as well as any
legal entity or partnership with legal capacity.
1.4. A “Consumer” is any natural person who uses the services for private purposes. An “Entrepreneur”
is any person who, when entering into a contract, acts in the exercise of their commercial or selfemployed professional activity.
1.5. “Credits” are digital units without monetary value that may be used exclusively for generating
digital trading cards, using the “Copy Function”, generating an example character, and using Print-Ready export or upscale functions on the Mythic Cards platform. Credits are not refundable and not payable in cash. Credits are not freely transferable to other Users, may not be gifted, and may not be traded. Credits may be used exclusively within the platform; any use outside the platform, in particular with third parties or as a general means of payment, is excluded. A system-side crediting of Credits to other Users occurs exclusively within the scope of the Copy Function pursuant to Section 2.5; this does not create any right to payout, free transfer, trading, or gifting.
1.6. “Race Tokens” are digital units that are credited to the User account regularly depending on the
selected subscription tier and are used exclusively to permanently save (“anchor”) races created in the race editor and/or to occupy a race slot. They are neither refundable nor payable in cash, tradable, nor transferable to other Users.
1.7. An “Original Card” is a card that a User generated or created with Mythic Cards, or created from
their own material, and that does not originate from the Copy Function.
1.8. A “Copied Card” is a private copy of a publicly accessible Original Card that is added to the
copying User’s Library through the Copy Function. Copied Cards are private Library items and are not eligible for public platform visibility unless the Provider expressly enables a different feature in the future.
1.9. A “Public Profile” is a publicly accessible creator profile. The User may feature up to four own
eligible Original Cards in a public “Showcase”.
1.10. “Monthly Generation Allowance” means a separate monthly quota that limits new AI card
generations and example-character generations during a billing period. It is distinct from Credits. The Monthly Generation Allowance is reset for each billing period and is not saved up or carried over without an express separate agreement. The Copy Function and Print-Ready export or upscale functions do not reduce the Monthly Generation Allowance.
1.11. “Closed Beta” means a limited availability phase in which subscription slots, plan changes, payment
flows, generations, Print-Ready exports, and related features may be limited, paused, or made available only gradually for capacity, cost, security, or stability reasons.
2. Subject Matter of the Contract and Service Description
2.1. The Provider operates the “Mythic Cards” online platform for AI-based generation of digital trading
cards (“digital cards”). Digital cards are generated using AI models of an external service provider (OpenAI). The specific results and functions may therefore depend on the availability and functionality of this service. The Provider has limited influence on the content details or any technical limitations of this service.
2.2. Users can specify the card name, the card rarity (“Uncommon”, “Rare”, “Epic”, “Legendary”, and
“Ultra Mythic”), and the card frame from a list, enter a description and motifs via prompts, and
optionally upload reference images to generate a trading card. The User must ensure they hold the necessary rights to any uploaded reference images. Reference images are used solely for style analysis and are not directly incorporated into the generated trading cards. Uploaded reference images are not published or shared and are deleted after the trading cards are generated.
2.3. Generation is credit-based: by clicking the “Generate” button, digital cards are created using
Credits. The generated cards are made available to the User account immediately and can be downloaded as image files (e.g., PNG/WebP) and optionally exported as a spritesheet (ZIP) for Tabletop Simulator or similar private game/tabletop workflows. Mythic Cards is not affiliated with, endorsed by, or officially connected to Tabletop Simulator or any other third-party game, tabletop, marketplace, or print provider unless expressly stated otherwise. New AI card generations additionally reduce the User’s Monthly Generation Allowance for the current billing period.
2.4. The number of Credits required to generate a card, generate an example character, or copy a card is
not based on rarity (“Uncommon”, “Rare”, “Epic”, “Legendary”, “Ultra Mythic”). Credit usage is based in particular on the selected quality level, the image size, the technical effort, the AI service used at the time of generation, and the platform’s current cost and pricing logic, including manufacturer/API costs of external providers. The platform may use current OpenAI image models and quality levels such as Medium and High. Medium quality generally requires fewer Credits and is intended for exploring ideas and generating more variants. High quality generally requires more Credits and is intended for final cards and higher technical detail. The concrete Credit amount shown for the respective Generate action, race example generation, or Copy Function before the action is triggered is decisive. The Provider is entitled to adjust the models used, available quality levels, image sizes, and associated credit costs if manufacturer/API costs change or technical developments require it. Quality levels are technical quality and cost settings; they do not guarantee any specific artistic result.
2.5. The User account includes a personal gallery (“Library”) and public platform features such as the
Discovery Board, Public Profile, Showcase, likes, copy features, Top Cards, rankings, and similar public areas or signals. The User may keep eligible cards private, unlisted, or public where the respective option is technically available. Public visibility is an optional platform feature and does not create a permanent right to publication, ranking, reach, likes, copy availability, or placement in Discovery, Top Cards, seasonal rankings, creator rankings, or other public areas. The Provider may curate, limit, hide, remove, pause, or disable public visibility and public platform features for capacity, security, abuse prevention, moderation, legal, rights-protection, or product reasons.
2.5.1. Copy Function and Creator Credits: Publicly accessible Original Cards of other Users can be added
to the copying User’s Library by using Credits via the “Copy card” button where technically available. Within the Copy Function, when copying a public or Showcase-accessible Original Card, the originally stored Credit amount for the copied card is automatically deducted system-side from the copying User’s balance and credited to the card creator. This stored original Credit amount may differ depending on the AI model, quality level, image size, and pricing version that applied when the original card was generated. The copying User sees the applicable Copy Credit cost before copying. The card creator receives exactly these Copy Credits as a system-side credit on the Mythic Cards platform. Creator Credits are platform Credits only. They are not money, not income, not a financial return, not payable in cash, not freely transferable, not tradable, and not a claim against the Provider outside the platform. They may be used only within Mythic Cards under the applicable platform rules. A User may copy a public card of another User only once.
2.5.2. Private use and restrictions for Copied Cards: Copied Cards are stored in the private Library of the
copying User. Subject to applicable law, third-party rights, these GTC, and the Content Policy, the copying User may use a Copied Card privately, including for their private collection, download, Print-Ready export, shirt/poster/merch workflow tests, private creative projects, and private game or tabletop projects. This does not guarantee that the User has commercial rights, merchandising rights, print-on-demand acceptance, third-party approvals, or freedom from copyright, trademark, personality, or other third-party rights. The User remains responsible for checking whether any private, commercial, print, merch, game, or tabletop use is lawful.
2.5.3. Public platform restrictions for Copied Cards: Copied Cards may not be published as public platform
cards. They may not appear on the Discovery Board, in a Public Profile Showcase, in Top Cards, rankings, season rankings, creator rankings, or other public platform rankings, and may not serve as a public copy source for other Users. Copied Cards may not be used to bypass, manipulate, dilute, or replace the public visibility, likes, Discovery placement, Copy Function, Creator Credits, or creator ranking of the Original Card or its original creator. Only the original creator may make the Original Card available for public platform surfaces such as Discovery, Public Profile Showcase, or other public areas, subject to these GTC and the platform’s technical and moderation rules. The Provider may technically enforce these restrictions and may limit or disable public visibility, Showcase eligibility, copy eligibility, like eligibility, ranking eligibility, or related features for Copied Cards.
2.5.4. Public Profile and Showcase: Users may use a public profile and may feature up to four own
eligible Original Cards in the Showcase. Showcase publication is separate from publication on the Discovery Board. A card may be visible in the Showcase on the User’s public profile without appearing on the Discovery Board. Other Users may view Showcase cards and, where technically available, like them and copy them through the Copy Function. The same Credit and Copy Function rules apply to eligible Showcase cards as to Discovery-public cards. Copied Cards and cards that are blocked, moderated, taken down, or otherwise not eligible for public visibility may not be featured in the Showcase. If a User removes a card from the Showcase, copies that were already created by other Users remain in their Libraries, subject to the private-use restrictions for Copied Cards.
2.6. Race creation: Depending on the subscription tier, the User may create and save their own
“Races/Peoples” (“race slots”). Creation includes: (i) definition (name, traits, attributes), (ii) generation of an example character using Credits, (iii) saving/anchoring using a Race Token. The Credit amount for generating an example character may vary depending on the selected AI model, quality level, image size, and current pricing logic; the amount displayed before generation is decisive. Using a Race Token to anchor a race is irreversible. Generating an example character additionally reduces the User’s Monthly Generation Allowance. The User may optionally publish self-created races. Published races may be used by other Users free of charge. If a published race is deleted by its original creator, it will no longer be publicly available.
2.7. Generated digital cards are available immediately in the User’s Library. Performance is deemed
provided once the card is displayed in the User account and download/export is technically enabled.
2.8. During Closed Beta or other limited availability phases, subscriptions may be limited per plan and a
visible subscription tier may be temporarily sold out or unavailable. Waitlist participation is non-binding and does not guarantee access to a subscription slot, a specific plan, or a specific launch price.
2.9. The Provider may temporarily pause new subscriptions, new AI generations, or new Print-Ready
exports for capacity, cost, security, maintenance, abuse-prevention, or stability reasons. Existing paid Credits remain subject to these GTC and can continue to be used once the relevant feature is available again, provided the User has an active subscription and the feature is otherwise available.
2.10. Print-Ready exports and upscale functions
2.10.1. Print-Ready export functions
Users with an active subscription can create temporary Print-Ready export files for their own cards. Standard Print Export creates a print-oriented PNG file with brightness and color correction. AI Enhanced Upscale creates a print-oriented PNG file using external AI upscaling or image enhancement services. Standard Print Export currently costs 1 Credit and AI Enhanced Upscale currently costs 3 Credits. The Credit amount displayed before the respective export is started is decisive.
2.10.2. Adaptive output size and file-size optimization
The requested base size for Print-Ready exports is up to 3600×5400 pixels in PNG format. To keep large PNG files below safer upload-size limits for most print-on-demand services, the final file may automatically be finalized at a slightly smaller 2:3 output size. The current internal targets are a preferred maximum file size of 48,000,000 bytes and a hard maximum file size of 49,000,000 bytes. These technical targets do not guarantee that every third-party provider will accept every file.
2.10.3. Third-party providers, print results and User responsibility
Print-Ready exports are technical helper files for upload to third-party providers. The Provider does not guarantee that every print-on-demand service will accept every file or that a specific print result will be achieved. Print quality and upload compatibility may vary in particular depending on the selected print provider, its current file requirements, upload limits, textile, shirt color, print process, placement, crop/bleed and other settings. The User is responsible for checking the requirements of the selected third-party provider before placing an order. Print-Ready exports do not guarantee that the underlying motif, prompt, uploaded image, card name, text, character, brand reference, or other content is free from third-party rights, including copyright, trademark, design, personality, publicity, or other rights. The User is responsible for ensuring that they have all rights required for the intended private, commercial, print, merch, resale, game, or tabletop use.
2.10.4. Temporary export artifacts and repeat download
Print-Ready exports are temporary export artifacts and are not permanent card assets. The Provider may limit the number of stored Print-Ready exports per User. Currently, the newest 10 Print-Ready exports per User are retained; older exports may be deleted automatically. As long as an export is available, downloading the same export artifact again is free of charge. Creating a new export requires an active subscription and may cost Credits.
2.10.5. Failures and Credit refund
If creation of a Print-Ready export fails before a usable export has been provided, the Credits deducted for that export are automatically refunded to the extent a charge has already occurred. This applies in particular if a file still exceeds the internal hard file-size limit after technical optimization, or if an external service required for AI Enhanced Upscale cannot be completed successfully. If a finished export already exists but a download link cannot be generated, the User can retry the download from Recent Print-Ready Exports.
2.10.6. Copied Cards and Print-Ready
Where technically available, Copied Cards may be used for private Print-Ready, shirt/poster/merch, creative, game, or tabletop workflows only within the limits set out in these GTC. This does not grant additional public platform rights and does not override the restrictions in Sections 2.5.2 and 2.5.3. Commercial use or resale is permitted only to the extent the User has all necessary rights and does not violate third-party rights, applicable law, these GTC, or the Content Policy.
3. Subscription Tiers, Credits and Payment
3.1. The User may choose between the following monthly subscription tiers:

3.2. Subscriptions are concluded for a term of one month.
3.3. Credits and Race Tokens are credited monthly according to the subscription tier. At the beginning
of each billing period, the Monthly Generation Allowance is also set according to the active subscription tier or the capacity settings displayed on the platform. Unless expressly stated otherwise, the Monthly Generation Allowance corresponds to the monthly Credits of the active plan, but it may be adjusted for capacity or launch reasons. Unused Credits and Race Tokens do not expire as long as the subscription is active. The Monthly Generation Allowance is reset for each billing period and does not accumulate. After cancellation, Credits and Race Tokens are suspended; they can only be used again after reactivating a subscription.
3.3.1. If the Monthly Generation Allowance for a billing period is used up, the User may no longer start
new AI card generations or example-character generations for that billing period. Remaining normal Credits may still be used for the Copy Function and Print-Ready exports or upscales, provided the User has an active subscription and the relevant feature is available.
3.4. Users with an active subscription can purchase additional Credits via one-off purchases (“Credit
Packs”):

3.5. Credit Packs can be purchased only by active subscribers. For expired or cancelled subscriptions,
Credits are locked until the subscription is reactivated, but do not expire as long as the User account exists.
3.6. All prices shown on the platform are final prices in euros. Pursuant to Section 19 of the German VAT
Act (UStG) (small-business regulation), no VAT is currently charged and therefore not shown. If VAT becomes applicable in the future (e.g., due to a change in VAT status), the final prices for consumers remain unaffected unless a price change is announced on a case-by-case basis in accordance with Section 12.3 (changes to these GTC/price adjustments). The Provider may offer temporary promotional prices or discounts. Promotional prices may differ from the regular list prices shown in these GTC. The total price displayed during the checkout process is decisive.
3.7. During Closed Beta or other limited availability phases, upgrades and downgrades may be subject
to available slots in the target plan. A plan change can be refused or postponed if the target plan has no available slot or if plan changes are otherwise paused. Unless expressly stated otherwise, scheduled upgrades and downgrades become effective only at the next billing period and do not grant additional Credits or Race Tokens immediately.
3.8. Credit Packs increase the User’s normal Credit balance only. They do not increase or reset the
Monthly Generation Allowance.
4. Payment Terms
4.1. Payment for subscriptions: Subscription fees are due in advance for each billing period (monthly)
upon subscription completion and on the same calendar day of each subsequent month. By subscribing, you authorize us to collect the agreed subscription fees via your chosen payment method on the due date. In the event of delays or chargebacks, we reserve the right to temporarily suspend access to the platform until full payment is received and to claim statutory default interest. Further claims remain unaffected.
4.2. Payment for one-off purchases: Payment for one-off purchases is due in advance upon completion
of the order process. Purchased Credits will be credited to the User account after receipt of payment.
4.3. All payments are processed exclusively via the payment service providers listed on the platform
website.
5. Contract Formation
5.1. Subscription contracts: The presentation of subscription tiers on the website does not constitute a
binding offer. Only by completing the order process and clicking the button indicating a payment obligation do Users submit a binding offer to conclude a subscription contract. Before completing the order process, Users must expressly confirm that they have taken note of these GTC and consent to the waiver of their right of withdrawal where applicable. The Provider accepts the offer by explicit confirmation by email or by activating the User account and subscription services. The contract text, including these GTC, will be provided to the User by email after conclusion of the contract.
5.2. One-off purchases (e.g., Credit Packs): The presentation of products on the website does not
constitute a binding offer. Only by completing the order process and clicking the button indicating a payment obligation do Users submit a binding offer to purchase. Before completing the order process, Users must expressly confirm that they have taken note of these GTC and consent to the waiver of their right of withdrawal where applicable. Acceptance occurs by crediting the purchased Credits to the User account or by explicit acceptance declaration by the Provider in text form. In this case as well, the User will receive the contract text, including these GTC, by email after conclusion of the contract.
6. Right of Withdrawal
6.1. You have the right to withdraw from this contract within fourteen (14) days without giving any
reason.
6.2. The withdrawal period is fourteen (14) days from the day the contract is concluded.
6.3. To exercise your right of withdrawal, you must inform us (Pacoma Creative Labs – Owner: Christian Renschler, c/o Impressumservice Dein-Impressum, Stettiner Str. 41, 35410 Hungen, Germany, Tel.: 01579-2341658, info@mythiccards.ai) of your decision
to withdraw from this contract by an unequivocal statement (e.g., by email).
6.4. You may use the attached model withdrawal form, but it is not obligatory:

6.5. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning
your exercise of the right of withdrawal before the withdrawal period has expired.
6.6. Effects of withdrawal: If you withdraw from this contract, we shall reimburse to you all payments
received from you without undue delay and no later than fourteen (14) days from the day on which we are informed about your decision to withdraw. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.
6.7. Expiry of the right of withdrawal: For contracts for digital content not supplied on a tangible
medium, the right of withdrawal expires prematurely if the Provider has begun performance and the Consumer has (i) expressly consented (e.g., by ticking a checkbox) to the Provider beginning performance before the end of the withdrawal period, (ii) acknowledged that they will lose their right of withdrawal once performance begins, and (iii) the Provider has provided the Consumer with a confirmation on a durable medium (e.g., by email).
7. Rights to Generated Content
7.1. The User receives a non-exclusive, worldwide and perpetual right to use the generated cards,
including for commercial use and resale, subject to any third-party rights (in particular trademark, copyright, and personality rights) and subject to these GTC. This does not mean that every generated card, Copied Card, Print-Ready export, name, prompt, reference, character, motif, or text is legally clear for every use case. The Provider does not guarantee freedom from third-party rights or suitability for commercial use, resale, merchandising, print-on-demand, game publication, marketplace use, or any specific third-party service.
7.2. No exclusive rights are granted to the generated cards. Identical or similar cards may also be
generated by other Users.
7.3. Use of the platform and the generated content is permitted only in compliance with these GTC, the
applicable OpenAI terms of use (currently available at https://openai.com/de-DE/policies/eu-terms-ofuse/), and applicable law. The Provider is entitled to adapt the content policy and usage conditions to any changes in OpenAI policies and technical developments.
7.4. The User is responsible for the lawful use of the content and its compatibility with third-party rights
(e.g., copyright, personality, trademark rights). This includes responsibility for prompts, uploaded images, card names, card text, character references, brand references, and other materials supplied or selected by the User. Any liability of the Provider in this regard is excluded to the extent permitted by law.
7.5. The User is responsible for ensuring that only content for which the User has the necessary rights is
made publicly visible on the Discovery Board, in a Public Profile, or in a Showcase.
7.6. Third-party brand names, game names, tabletop tools, marketplaces, print providers, or other
services may be mentioned only descriptively where necessary. Unless expressly stated otherwise, Mythic Cards is not affiliated with, endorsed by, sponsored by, or officially connected to such third-party services.
8. Content Policy and Prohibited Content
8.1. The following content is prohibited from generation in particular and violates the content policy:
- Protected brands/characters (e.g., Disney, Marvel, Star Wars, etc.).
- Real persons without their consent.
- Content that glorifies violence, sexually explicit content, discriminatory content, or politically extremist content.
- Illegal, criminal, or insulting content as well as content that violates public morals or the platform guidelines.
8.2. The Provider reserves the right to update the content policy on an ongoing basis to reflect legal
changes, technical changes, and requirements of the AI service provider (OpenAI). The current version is available on the platform and is binding.
8.3. The Provider is entitled to reject or delete User requests/content that violates this content policy.
8.4. In the event of material or repeated violations after a written warning in text form, the Provider
may suspend User accounts and terminate the subscription without notice; Credits may be forfeited in such cases.
8.5. The content policy also applies to Public Profiles and Showcase cards. The Provider may restrict,
hide, remove or disable Public Profiles, Showcase cards or public card visibility where content violates these GTC, third-party rights, applicable law or the content policy.
8.6. Users may report public or otherwise publicly accessible cards, Public Profiles, Showcase cards, or
related public content where they believe that the content violates these GTC, the Content Policy, third-party rights, applicable law, safety requirements, or platform rules. A report does not automatically lead to removal, restriction, refund, or any specific action.
8.7. Reports may be reviewed by the Provider, admins, moderators, or authorized operators. After review,
the Provider may in particular dismiss the report, mark the content as under review, restrict or remove public visibility, block Discovery, Showcase, Copy Function, like, ranking, or republishing features for the content, restore public eligibility, or take another appropriate measure. Restore or republishing after a moderation action is possible but not guaranteed.
8.8. A takedown or public-visibility block does not necessarily delete the card from the private Library of
the owner. In serious or repeated cases, or where required for rights protection, security, legal compliance, or abuse prevention, the Provider may take further measures, including restricting accounts, Credits, uploads, public features, Copy Function access, or deleting content to the extent permitted by law.
8.9. Public web or thumbnail derivatives and already known public links may require separate technical
handling. A public-visibility block in the platform database does not necessarily mean that every previously known file URL is immediately deleted or revoked, although the Provider may remove or revoke files where appropriate or required.
8.10. The Provider may restrict public visibility independently of the number of reports if the content,
account behavior, or public interaction appears to violate the Content Policy, third-party rights, safety requirements, applicable law, anti-abuse rules, or the integrity of public platform areas.
9. Liability and Warranty
9.1. The Provider does not guarantee specific results or characteristics of generated content; in
particular, the quality of generated cards may vary. Medium and High are technical quality and cost levels for the generation process and do not guarantee a specific artistic result.
9.2. Statutory provisions apply to defects of quality and title unless otherwise stipulated in these GTC.
9.3. The Provider is liable without limitation for damages arising from injury to life, body, or health that
result from an intentional or grossly negligent breach of duty by the Provider, its legal representatives, or vicarious agents. For all other damages, liability for slight negligence is excluded.
9.4. Any further liability is excluded. This applies in particular to claims by third parties, such as claims by
OpenAI against Users. The Provider does not provide indemnification.
9.5. Force majeure: The Provider is not liable for delays or failures caused by events beyond its control,
such as natural disasters, war, terrorism, labor disputes, governmental measures, failures of communication networks, power outages, or other unforeseeable, unavoidable, and serious events. The Provider expressly notes that it has no influence on technical limitations or outages of the AI service provider (OpenAI); such cases are treated as force majeure. If a force majeure event lasts longer than four weeks, either party may terminate the contract with immediate effect. Statutory claims remain unaffected.
9.6. The Provider is not liable for data loss or technical disruptions caused by third-party outages, force
majeure, or technical issues not attributable to the Provider. Goodwill services, such as granting additional Credits, are voluntary and do not create any legal entitlement for the future.
10. Data Protection
10.1. The processing of personal data is governed by the Provider’s privacy policy, which is available on
the platform at the following link: https://mythiccards.ai/legal/privacy. Further information on how personal data is handled, including purposes, legal bases, and data subject rights, can be found in the privacy policy.
10.2. Publicly visible profile and Showcase data may include in particular the creator name, Showcase
cards, like counts and copy counts. Further details are set out in the privacy policy.
11. Term, Cancellation, Deletion and Discontinuation of the Service
11.1. By subscribing, you agree that your subscription will automatically renew after the agreed term for
the originally agreed duration unless you cancel beforehand. You authorize us to charge the subscription fees for renewal using the payment method you have provided. The renewal price corresponds to the most recently charged regular subscription price, excluding limited-time promotional or discount prices. We will inform you in good time before any subscription price change becomes effective.
11.2. Cancellation of the subscription is possible with one month’s notice to the end of the current
billing period. Cancellation is available (i) via the cancellation button in your account (“Cancel now” under Settings → Subscription → Cancel) and (ii) via the public cancellation page at https://mythiccards.ai/cancel-subscription (no login required). If the cancellation button or cancellation page is temporarily unavailable, cancellation may alternatively be made by email to info@mythiccards.ai. We will confirm the cancellation in text form (e.g., by email).
11.3. Users can delete their account at any time. Upon account deletion, all Credits are forfeited; all
generated cards and saved content are permanently deleted.
11.4. The Provider may discontinue the platform with at least one month’s notice without stating
reasons. Users may use remaining Credits and download content during this period; no refunds will be granted.
11.5. For good cause not attributable to the Provider (e.g., permanent discontinuation or significant
restriction of the current external service provider), the Provider is entitled to change the external service provider used for generating digital cards with at least four weeks’ prior notice. The Provider will inform Users in text form. If the change results in a material deterioration of the agreed services, the User has a special right of cancellation effective at the time of the change. Statutory claims and mandatory consumer protection rights remain unaffected.
11.6. In the event of material changes, restrictions, or discontinuation of the external AI service
provider, the Provider will inform Users in good time about the effects on the platform and usage options in text form. In the event the external service provider is discontinued, the Provider is entitled to discontinue the platform without observing a notice period.
11.7. In the event of violations of these GTC, in particular abusive use of the platform, the Copy
Function, public visibility, likes, Discovery placement, rankings, Creator Credits, or circumvention of technical safeguards, the Provider may take appropriate measures. Manipulation of likes, copy actions, public visibility, Discovery, Top Cards, creator rankings, Copy Rewards, Creator Credits, or similar public signals is prohibited. Appropriate measures include in particular temporary suspension of public features, Copy Function restrictions, Credit or reward restrictions, temporary suspension of the User account, permanent suspension after a written warning in text form, and termination of the user agreement without notice. Credits may be forfeited without compensation in such cases. The Provider is also entitled to block or delete content if there is reasonable suspicion that third-party rights are being infringed. Further claims and the assertion of damages remain reserved.
12. Final Provisions
12.1. The laws of the Federal Republic of Germany shall apply. Mandatory consumer protection
provisions of the state in which you have your habitual residence remain unaffected.
12.2. If the customer is a merchant, a legal entity under public law, or a special fund under public law,
the place of jurisdiction shall be the Provider’s registered office.
12.3. The Provider is entitled to amend these GTC to the extent necessary to adapt to changes in law,
technical developments, or requirements of third parties (in particular the AI service provider OpenAI). The User will be informed in text form at least four weeks before any intended changes take effect. If the User does not object within four weeks of receiving the notice, the changes shall be deemed accepted. The User will be specifically informed of the right to object and the consequences of failing to object. In the event of a timely objection, the existing contractual relationship will continue. In this case, the Provider has a special right of termination effective at the time the changes take effect.
12.4. Insofar as these GTC do not contain more specific provisions, the terms and policies set by OpenAI
apply as a minimum standard for all Users.
13. Severability
13.1. If any provision of these GTC is or becomes invalid, the validity of the remaining provisions shall
remain unaffected. The statutory provisions shall apply in place of the invalid provision.
